Making A Purchase
We accept credit and debit card payment. You will receive confirmation to indicate we have received your order. This does not indicate that a contract exists between us. We will indicate acceptance of your order, and hence a contract between us, when we send you an invoice. We have included this term to protect us in the case that a mistake has been made in pricing or we have inadvertently under-priced goods, or we are no longer able to supply a particular product for some reason. In the case of a change of price, we will always contact you first to ensure that the price is acceptable.
Contact lenses on the site are only available in pairs. To purchase individual lenses please contact your nearest store.

We want you to be delighted with your purchase. That is why we offer a 7 day money back guarantee should you decide to return your order. Goods must be returned in their original packaging within 7 days of your order being received and signed for. See returns policy for more information.
We can only supply contact lenses to the specification provided by your optician for the period for which it is valid. When ordering contact lenses from Optical Express Direct for the first time you will need to send us a copy of your prescription. Alternatively you can provide us with your optician’s contact details in order that we can verify your contact lens specifications or you can arrange a contact lens consultation* at any of the 200 Optical Express stores throughout the U.K.
By placing an order for contact lenses, you are confirming that you have a valid in-date contact lens specification from your optician for the contact lenses which you have ordered, and that the information you enter into our site matches your contact lens specification as provided by your optician. You consent to your optician being contacted by Optical Express to verify your contact lens specification and any other necessary information.
Re-ordering is easy as we will retain your contact lens prescription for future orders.

Delivery Schedule
All orders placed at http://www.opticalexpress.co.uk will normally be dispatched within 48 hours subject to availability. The overall delivery period should not be more than 21 days. Your goods will be delivered by Royal Mail Recorded Delivery and will require a signature.

Using our Website indicates that you accept the Terms. If you do not agree to these, then please do not use our Website. You are permitted to use our Website solely on the basis of these Terms. OPTICAL EXPRESS reserves the right, at our discretion, to update and/or revise these Terms. Please check periodically for changes.

THIS IS AN AGREEMENT BETWEEN YOU AND OPTICAL EXPRESS
1. DEFINITIONS
In these Terms, the following words and phrases will have the following meanings: "Order" means a purchase order issued by you to us in accordance with these Terms in respect of Products; "Products" means the products which we supply in accordance with these Terms.
2. USE OF THIS WEBSITE
2.1. So long as you do so in accordance with these Terms, you may view and download our Website for your personal use only. However, you must note that we may change, suspend or discontinue the Website or the provision of Products under the Website at any time, including the availability of any feature, database, or content. OPTICAL EXPRESS may also impose limits on certain features and services or restrict your access to parts or the entire Website without notice or liability.
2.2. You are responsible for obtaining and maintaining any equipment or ancillary services needed to connect to, access or otherwise use the Website, including, without limitation, modems, hardware, software, and long distance or local telephone service.
3. REGISTRATION & SECURITY
3.1. To participate in the http://www.opticalexpress.co.uk online service, to place Orders and to receive Products via the Website, you must:
* be 18 years of age or over;
* have a valid credit or debit card in your name;
* be resident (and remain resident) in the United Kingdom; and
* complete our registration procedure in which you will need to provide us with personal details needed to process your order.
3.2. You must ensure that the details which you provide during registration or at any time after registration are correct and complete.
4. PRICES & PAYMENT
4.1. The prices which you must pay for the Products that you Order are set out on the Website at the time you place your order, except where we discover an error in the price of the Products you have ordered. In this event, we will inform you as soon as possible after receiving your Order and give you the option of reconfirming your Order at the correct price or cancelling it. If we are unable to contact you we will treat the Order as cancelled.
4.2. Prices shown on the Website are inclusive of VAT, where applicable.
4.3. We may delay dispatch until receipt of authorisation is received for payment to be taken from the payment card provided. You can pay by any Mastercard or Visa credit card, Switch or Delta debit card, Solo cards or Electron cards. Your credit/debit card details will be encrypted to protect your personal card information.
5. ORDER & ACCEPTANCE
5.1. You may place Orders using the online process for ordering Products via the Website.
5.2. When you place an Order with us, we need to obtain various details from you so that we can process your Order. You must ensure that the details which you provide each time you place an Order are correct and complete.
5.3. Once you have placed an Order to purchase a product from the Website you will receive an e-mail regarding the status of your order.
5.4. Your Order is an offer to purchase Products from us, which is subject to our acceptance in accordance with these Terms. When confirmation of your order is received, this is to indicate that we have received your Order. It does not indicate that a contract exists between us. We will indicate acceptance of your Order, and hence the formation of a contract between us (Contract), when we send you an invoice. We have included this term to protect us in the case that a mistake has been made in pricing, or we have inadvertently under-priced goods, or we are no longer able to supply a particular product for some reason. In the case of a change of price, we will always contact you first to ensure that the price is acceptable.
5.5. Therefore, all Orders are subject to verification, us receiving payment and also stock availability.
5.6. If the Products ordered are not available, you will be notified by our Contact Lens department using the contact details you have provided and you will have the option either to (i) wait until the Products are available from stock; or (ii) cancel your Order.
5.7. Any Product may be available at a discounted price, for a limited period of time.
6. DELIVERY
6.1. Delivery will be made to the address specified by you when you place your Order. This cannot vary from your payment card address. Please note that we can only deliver Products within England, Scotland, Wales and Northern Ireland. We cannot deliver to P.O Box addresses.
6.2. We will do our best to deliver within 48 hours, provided we are able to obtain funds from your payment card. However, we cannot be held responsible for ensuring stock of each specific Product is available at all times or for delays or failures due to adverse weather, traffic delays, mechanical breakdowns or other circumstances beyond our control.
6.3. Delivery is free on all orders using the online process for ordering Products via the Website.
6.4. Ownership of the Products you Order on the Website shall pass to you on delivery provided that we have processed your card payment and received the full value for such Products.
7. CANCELLATION
You may cancel your Order at any time prior to dispatch by calling our Contact Lens Department on 01236 795088 or by emailing us at contactlenses@opticalexpress.com. If you wish to cancel your Order after the Products have been dispatched, you will have to return them to us in accordance with the returns procedure set out in condition 8 below.
8. RETURNS
8.1. To ensure we can process your refund or replacement effectively, we unfortunately cannot accept returns to Optical Express branches. Please follow the refund and returns below. Products can be returned:
8.1.1. If contact lens are supplied to the wrong specification or are supplied damaged. Optical Express may not be held responsible if you are intolerant to any contact lens or contact lens products you have ordered. If you believe your goods are faulty or damaged please state this when you contact us. Our Contact Lens Department will then send you return packaging. However Optical Express will not be responsible for any contact lens or contact lens products that are damaged due to mishandling. If our Quality Control department find that there is a manufacturing fault we will issue you with replacement contact lenses. If we have no replacement contact lenses available then you will be given a refund.
8.1.2. If for any reason you are not happy with your order you can return it to us via Royal Mail Recorded delivery (OPTICAL EXPRESS is not liable for this expense) Your order must be returned in its original packaging within 7 days of receiving it. Only complete, unopened product will be accepted for refund.
8.2. Please contact our Contact lens Department on 01236 795088 or email us at contactlenses@opticalexpress.com if you wish to return any contact lenses products.
8.3. We will credit your account once the Product(s) have been received by us and has been checked to ensure that the returns policy has been correctly adhered to. As soon as this is completed we will refund the full amount paid. Please note that we can only make refunds to the card that was used to place the original order.
9. PRIVACY POLICY
9.1. OPTICAL EXPRESS does not disclose buyers' information to third parties other than when order details are processed as part of the order fulfilment. In this case, the third party will not disclose any of the details to any other third party.
9.2. Your email address is essential in order for us to be able to supply you with important information such as order confirmations and changes to the service.
9.3. Cookies are used on this shopping site to keep track of the contents of your shopping cart, to store delivery addresses if the address book is used and to store your details if you select the 'Remember Me' Option. They are also used after you have logged on as part of that process. You can turn off cookies within your browser by going to 'Tools | Internet Options | Privacy' and selecting to block cookies. If you turn off cookies, you will be unable to place orders or benefit from the other features that use cookies.
10. LIABILITY
10.1. Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence or fraudulent misrepresentation.
10.2. In the absence of any negligence or breach of duty by us, your use of any of the Products other than in accordance with their instructions is entirely at your own risk.
10.3 Subject to paragraph 10.1 above our liability in connection with any Product purchased through our Website is strictly limited to the purchase price of that Product.
10.4. You will be responsible for all liabilities, claims and expenses that arise out of the content you submit, post or transmit via the Website, or from your use/misuse of the Website or the use/misuse by any person for whom you are responsible or from your violation of the Terms.
10.5. OPTICAL EXPRESS warrants that it will provide the Products with reasonable skill and care, within a reasonable time, and substantially as described in these Terms. OPTICAL EXPRESS does not make any other promises or warranties about the provision of the Products.
10.6. OPTICAL EXPRESS cannot assume any liability for:
10.6.1. any viruses or any other disabling features that affect your access to or use of the Website;
10.6.2. any incompatibility between the Website and other websites, services, software and hardware;
10.6.3. any delays or failures you may experience in initiating, conducting or completing any transmissions or transactions in connection with the Website;
10.6.4. any modification, suspension or discontinuance of the Website.
10.7. If either you or we are in breach of the arrangements under these Terms, neither of us will be responsible for any losses that the other suffers as a result, except those which are a foreseeable consequence of the breach. Losses are foreseeable where they could be contemplated by both you and us at the time you place an Order.
11. INTELLECTUAL PROPERTY RIGHTS
11.1. The content of the Website is protected by copyright, trade mark, database and other intellectual property rights. You may retrieve and display the content of the Website on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the Website without written permission from OPTICAL EXPRESS.
11.2. No licence is granted to you in these Terms to use any trade mark of OPTICAL EXPRESS or its affiliated companies.
12. THIRD PARTY RIGHTS
A person who is not party to this agreement shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement. This clause does not affect any right or remedy of any person which exists or is available otherwise than pursuant to that Act.
13. WRITTEN COMMUNICATIONS
Applicable laws require that some of the information or communications we send to you should be in writing. When using our site, you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.
14. NOTICES
All notices given by you to us must be given to Optical Express at 5 Deerdykes Road, Westfield Industrial Estate, Cumbernauld, Glasgow, G68 9HF OR customerservices@opticalexpress.com. We may give notice to you at either the e-mail or postal address you provide to us when placing an order, or in any of the ways specified in paragraph 13.
Notice will be deemed received and properly served immediately when posted on our website, 24 hours after an e-mail is sent, or three days after the date of posting of any letter. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an e-mail,that such e-mail was sent to the specified e-mail address of the addressee.
15. TRANSFER OF RIGHTS AND OBLIGATIONS
15.1 The contract between you and us is binding on you and us and on our respective successors and assigns.
15.2 You may not transfer, assign, charge or otherwise dispose of a Contract, or any of your rights or obligations arising under it, without our prior written consent.
15.3 We may transfer, assign, charge, sub-contract or otherwise dispose of a Contract, or any of our rights or obligations arising under it, at any time during the term of the Contract.
16. EVENTS OUTSIDE OUR CONTROL
16.1 We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control (Force Majeure Event).
16.2 A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:
(a) Strikes, lock-outs or other industrial action.
(b) Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war.
(c) Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster.
(d) Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
(e) Impossibility of the use of public or private telecommunications networks.
(f) The acts, decrees, legislation, regulations or restrictions of any government.
16.3 Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event.
17. WAIVER
17.1 If we fail, at any time during the term of a Contract, to insist upon strict performance of any of your obligations under the Contract or any of these terms and conditions, or if we fail to exercise any of the rights or remedies to which we are entitled under the Contract, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations.
17.2 A waiver by us of any default shall not constitute a waiver of any subsequent default.
17.3 No waiver by us of any of these terms and conditions shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing in accordance with paragraph 14 above.
18. SEVERABILITY
If any of these terms and Conditions or any provisions of a Contract are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.
19. ENTIRE AGREEMENT
19.1 These terms and conditions and any document expressly referred to in them represent the entire agreement between us in relation to the subject matter of any Contract and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.
19.2 We each acknowledge that, in entering into a Contract, neither of us has relied on any representation, undertaking or promise given by the other or be implied from anything said or written in negotiations between us prior to such Contract except as expressly stated in these terms and conditions.
19.3 Neither of us shall have any remedy in respect of any untrue statement made by the other, whether orally or in writing, prior to the date of any Contract (unless such untrue statement was made fraudulently) and the other party's only remedy shall be for breach of contract as provided in these terms and conditions.
20. OUR RIGHT TO VARY THESE TERMS AND CONDITIONS
20.1 We have the right to revise and amend these terms and conditions from time to time.
20.2 You will be subject to the policies and terms and conditions in force at the time that you order products from us, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if we notify you of the change to those policies or these terms and conditions before we send you the invoice for your Product(s) (in which case we have the right to assume that you have accepted the change to the terms and conditions, unless you notify us to the contrary within seven working days of receipt by you of the Products).
21. GOVERNING LAW
These Terms are subject to Scottish law. We will try to solve any disagreements quickly and efficiently. If you are not happy with the way we deal with any disagreement and you want to take court proceedings, you must do so within the United Kingdom.
